TAM-Kiosk usage Terms and Conditions

The following are the terms and conditions (these “Terms”) apply to all and any Transactions (as defined below) initiated and completed by you using the Kiosk. By using and continuing to access the Kiosk, you are deemed to have read, accepted, and be unconditionally bound by these Terms. 1. Definitions: For the purpose of these Terms: 1.1. Card means a debit or credit card accepted by Credimax, including but not limited to, Benefit cards, MasterCard or VISA card. 1.2. Kiosk means a freestanding kiosk, available at the Merchant’s premises, owned by PIE or any other party engaged by PIE, to process and complete a Transaction. 1.3. Merchant means the place where the Kiosk is available for use by you. 1.4. PIE means Payment International Enterprise B.S.C. (c). 1.5. Product(s) means all the products offered by the Kiosk including but not limited to, telecom, loyalty, gifting, gaming, cross border, web payment, prepaid vouchers, government services and bill collection services in the Kingdom of Bahrain. 1.6. Service Provider(s) means any private or government entity that provides the Products to you through the Kiosk. 1.7. Transaction(s) means a payment transaction made through the Kiosk for one or more of the Products. 1.8. Voucher(s) means an electronically dispensed voucher that has a value, serial number and expiry date that can be used as a payment method to complete a Transaction. 1.9. You or Your means the customer of the Merchant using the Kiosk. 2. Use of Kiosk: 2.1. The Kiosk enables you to process and complete Transactions. 2.2. You may only process one Transaction at a time via the Kiosk. 2.3. Once a Transaction is successfully completed by you, you shall receive a receipt confirming the completion of the Transaction. 2.4. No refunds can be made once a Transaction has been successfully completed by you. 2.5. In case a Transaction is not successfully completed, for any reason whatsoever, after payment is made by you in cash or by Card, you shall receive a cash refund equivalent to the value paid. If a cash refund is not possible, for any reason whatsoever, you shall recieve a Voucher amounting to the value you have paid in cash or by Card. Such Voucher can be used by you to process and complete any Transaction. 2.6. Your use of any of the Products is governed by the terms, conditions, disclaimers and notices found with the Service Provider of the relevant Product. PIE is in no way liable in relation to any purchases and/or payments you make using the Kiosk. 2.7. PIE does not control, endorse, or accept responsibility for the Products. Any dealings between you and any Service Provider in connection with a Product, including the Service Provider’s privacy policies and use of your personal information, delivery of and payment

for goods and services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such Service Provider. 2.8. The Kiosk will always be watched by security cameras (CCTV). 3. Payment Methods: 3.1. You may complete a Transaction by any one of the following methods: 3.1.1. By cash (you may insert at a time a maximum of 600 notes; or Bahraini Dinars 7,500 or its equivalent in Saudi Riyals); 3.1.2. By debit or credit card; or 3.1.3. By a Voucher. 3.2. All Transactions must be made in Bahraini Dinars or Saudi Riyals. No other currencies shall be accepted in the Kiosk. 3.3. In case of payment for the Products in Saudi Riyals at the Kiosk, PIE shall have the right from time to time to determine the foreign exchange rate. 3.4. The currency for all cash refunds and Vouchers will be Bahraini Dinars only. 4. Authorized Card User: 4.1. In case you opt to pay any Transaction by Card, you are wholly responsible for the use of your Card. 4.2. If another person other than you uses your Card to complete a Transaction, PIE will treat this as if you have authorized such use and you will be responsible for all Transactions completed by that person. 5. Customer Support: 5.1. For any customer support related issues please call the customer support helpdesk on [8000 8778]. 6. Liability: 6.1. PIE will not be liable to you if you are unable to perform any of the Transactions via the Kiosk due (directly or indirectly) to the failure of any equipment, data processing system or transmission link or due to any other cause beyond PIE’s control. 6.2. You shall be liable and wholly responsible for any damage, destruction or malfunction caused to the Kiosk by you. 6.3. You shall be liable for damages sustained in the event of death, wounding or any other bodily injury caused by the Kiosk due to your negligence or other wrongful act or omission, PIE may be exonerated wholly or partly from its liability in accordance with applicable laws. 6.4. PIE is not liable for any damages suffered by you arising from PIE’s compliance with or your failure to comply with the terms set by your Service Provider, the applicable laws or the government’s rules and regulations. 7. Indemnification: 7.1. You shall be liable for, and shall indemnify and hold harmless PIE with respect to all claims, losses, liabilities, costs, expenses or damages claimed by any third party and suffered by PIE due to damage, destruction or malfunction caused to the Kiosk by you.

8. Severability: 8.1. If any provision of these Terms are or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the legality, validity or enforceability in that jurisdiction of any other provision of these Terms; or the legality, validity or enforceability in any other jurisdiction of that or any other provision of these Terms. 9. Waiver: 9.1. Failure of PIE to enforce at any time any of the provisions of these Terms will not be construed to be a continuing waiver of any provision under these Terms nor will any such failure prejudice PIE’s right to take any action in the future to enforce any provisions of these Terms. 10. Governing Law & Jurisdiction: 10.1. These Terms shall be governed by the construed in accordance with the laws of the Kingdom of Bahrain. 10.2. Any dispute arising out of or in connection with these Terms shall be referred to and settled by the competent court of the Kingdom of Bahrain. 11. Entire Agreement: 11.1. The terms contained in these Terms constitute the entire agreement between you and PIE with respect to its subject matter and supersedes any prior representations and agreements, oral or written, and all other communications between the you and PIE relating to its subject matter. 12. Interpretation: 12.1. The title of each Article of these Terms is for convenience only, and is not to be used for interpretation of the text.
